POLITIQUE D'UTILISATION ACCEPTABLE DE RINGCENTRAL
RINGCENTRAL ACCEPTABLE USE POLICY
Any and all use of RingCentral Services is subject to and conditioned upon compliance with the following Acceptable Use Policy (“AUP”). If you have an Agreement with RingCentral, this AUP is incorporated into and made a part of your Agreement with RingCentral.
The Services (including any device, system, network, or account used in connection with the Services, or the RingCentral Network) may not be used to:
Illegal activity. Violate any law or regulation applicable to the use of the Services.
Infringing activity. Infringe, misappropriate, or otherwise violate RingCentral’s or anyone’s rights (including intellectual property, privacy, personality, publicity, or otherwise; or display or use RingCentral’s marks without consent or in violation of RingCentral policies).
Auto-dialing; trunking; traffic pumping. Perform auto-dialing or “predictive dialing” in an abusive manner; trunk or forward your RingCentral phone or fax number to other numbers that handle multiple simultaneous calls or to a private branch exchange (PBX) or a key system; traffic pumping or access stimulation of calls through the Services or the RingCentral Network.
Minors. Exploit or harm minors (e.g., expose them to inappropriate content; ask for personally identifiable information without parental consent).
Interference; transmit viruses. Interfere, inhibit, compromise, or otherwise harm the Services or the RingCentral Network (regardless of intent or knowledge); transmit any material that contains viruses, time or logic bombs, Trojan horses, worms, malware, spyware, or any other programs that may be harmful or dangerous.
Objectionable activity. Act in an indecent, offensive, threatening, harassing, defamatory, libelous, fraudulent, malicious, disruptive, tortious, or other objectionable manner; or create a false caller ID identity (i.e., ID spoofing), forge addresses or headers, or otherwise mislead others about a sender’s identity or origin.
Driving; safety. Use while driving or otherwise in an unsafe manner.
Harvest information; spam; bulk messages. Harvest or collect information about third parties or End Users without consent; send bulk communications or other content without the recipient’s consent.
Excessive or unauthorized use. Use any device, system, network, account, plan, or the Services in an unauthorized manner or in excess of reasonable business use.
Circumvent compliance or security. Take advantage of, bypass, exploit, defeat, disable, or otherwise circumvent limitations of the Services, security mechanisms, or compliance with this AUP or any law.
Interception. Intercept, capture, sniff, monitor, modify, emulate, decrypt, or redirect any communication or data for any purpose.
Resale Prohibited. Customer may not sell, resell, sublease, assign, license, or sublicense the Services or any component thereof or use or offer the same on a service-bureau or time-sharing basis.
High Risk Use Prohibited. THE SERVICES ARE NOT DESIGNED, MANUFACTURED, INTENDED, OR RECOMMENDED FOR USE FOR ANY HIGH-RISK OR FAIL-SAFE PURPOSE OR ACTIVITY OR IN ANY ENVIRONMENT WHERE FAILURE, INTERRUPTION, MALFUNCTION, ERROR, OR UNAVAILABILITY COULD RESULT IN PHYSICAL HARM OR PERSONAL INJURY, DEATH OR DISMEMBERMENT, OR PROPERTY OR ENVIRONMENTAL DAMAGE. CUSTOMER SHALL NOT USE THE SERVICES FOR ANY SUCH PURPOSE OR ACTIVITY OR IN ANY SUCH ENVIRONMENT.
The list above is not exhaustive or exclusive. For purposes of this AUP, “End User” means an individual user of the Services, and may be a natural person, and may include but is not limited to a Customer’s employees, consultants, clients, external users, invitees, contractors and agents. Except as otherwise provided, terms defined in the Agreement have the same meanings when used in this AUP. The Services must be used only in accordance with and subject to RingCentral’s Emergency Services Policy, located at https://www.ringcentral.ca/legal/emergency-services.html and RingCentral’s Privacy Notice, located at https://www.ringcentral.ca/legal/privacy-notice.html.
RingCentral may act immediately and without notice to suspend or terminate the Services if, in RingCentral’s sole discretion, Customer’s or its End Users’ use of the Services violates the terms of this Acceptable Use Policy.
Customer may cancel any services purchased under this Agreement with written notice to RingCentral within thirty (30) days of the date in which the purchase becomes effective. Except as otherwise provided in the Agreement between the Parties, in the event of a timely cancelation, Customer shall not owe any fees or charges for the services being canceled in respect of any period subsequent to the date of such written notice (except those arising from continued Usage), and shall be entitled to a pro-rata refund of any prepaid and unused fees for the services subject to the cancelation. All purchases are final after 30 days.
POLITIQUE D'UTILISATION ACCEPTABLE DE RINGCENTRAL
Toute utilisation des Services de RingCentral est soumise et limitée par la conformité avec la Politique d'utilisation acceptable (« PUA ») suivante. Si vous disposez d'une Entente avec RingCentral, cette PUA fait partie intégrante de votre Entente avec RingCentral.
Les Services (y compris tout appareil, système, réseau ou compte utilisés dans le cadre des Services ou du réseau RingCentral) ne peuvent pas être utilisés aux fins suivantes :
Activités illégales. Enfreindre toute loi ou réglementation applicable à l'utilisation des Services.
Activité de contrefaçon. Léser, détourner ou violer de toute autre manière les droits de RingCentral ou de toute autre personne (y compris la propriété intellectuelle, la vie privée, le caractère personnel, la publicité ou autre; ou afficher ou utiliser les marques de RingCentral sans consentement ou en violation des politiques de RingCentral).
Numérotation automatique ; interconnexion ; augmentation du trafic. Faire de la numérotation automatique ou de la « numérotation prédictive » de manière abusive ; utiliser le numéro de téléphone ou de télécopieur RingCentral pour transférer votre numéro vers d'autres numéros qui traitent plusieurs appels en même temps ou vers un autocommutateur privé (PBX) ou un système à touches; l’augmentationdu trafic [traffic pumping]ou la stimulation de l'accès [access stimulation] aux appels par l’entremise des Services ou le Réseau RingCentral.
Mineurs. Exploiter ou porter atteinte aux mineurs (par exemple, les exposer à un contenu inapproprié ; demander des informations permettant de les identifier sans le consentement des parents).
Interférence ; transmission de virus. Interférer, inhiber, compromettre ou nuire de quelque manière que ce soit aux Services ou au Réseau RingCentral (sans égard à l'intention ou à la connaissance) ; transmettre tout matériel qui contient des virus, des bombes temporelles ou logiques, des chevaux de Troie, des vers, des logiciels malveillants, des logiciels espions ou tout autre programme qui pourrait se révéler nuisible ou dangereux.
Activités répréhensibles. Se comporter de manière indécente, offensante, menaçante, harcelante, diffamatoire, frauduleuse, malveillante, perturbatrice, délictueuse ou de toute autre manière répréhensible ; ou créer une fausse identité d'appelant [caller ID] (c'est-à-dire la mystification de l'identité de l'appelant), falsifier des adresses ou des en-têtes, ou induire en erreur sur l'identité ou l'origine d'un expéditeur.
Conduite ; sécurité. Utilisation au volant ou tout autre utilisation de manière dangereuse.
Collecte d'informations ; spam ; emails groupés. Collecter ou recueillir des informations sur les tiers ou les Utilisateurs finaux sans leur consentement ; envoyer des emails groupés ou d'autres contenus sans le consentement du destinataire.
Utilisation excessive ou non autorisée. Utilisation de tout dispositif, système, réseau, compte, plan ou service d'une manière non autorisée ou qui excède l'usage commercial raisonnable.
Contournement de la conformité ou de la sécurité. Tirer profit, contourner, exploiter, vaincre, désactiver ou éviter de toute autre manière les limitations des Services, les mécanismes de sécurité ou le respect de la présente PUA ou de toute loi.
Interception. Intercepter, saisir, subtiliser, surveiller, modifier, émuler, décrypter ou réorienter toute communication ou donnée à quelque fin que ce soit.
Interdiction de revente. Le client ne peut vendre, revendre, sous-louer, céder, accorder une licence ou une sous-licence pour les Services ou tout composant de ceux-ci, ni les utiliser ou les offrir sur une base de partage de services ou de temps partagé.
Interdiction des utilisations à haut risque. LES SERVICES NE SONT PAS CONÇUS, FABRIQUÉS, DESTINÉS OU RECOMMANDÉS POUR UNE UTILISATION À DES FINS OU DES ACTIVITÉS À HAUT RISQUE OU À SÉCURITÉ INTÉGRÉE OU DANS UN ENVIRONNEMENT OÙ UNE PANNE, UNE INTERRUPTION, UN DYSFONCTIONNEMENT, UNE ERREUR OU UNE INDISPONIBILITÉ POURRAIT ENTRAÎNER DES DOMMAGES CORPORELS OU DES BLESSURES, UN DÉCÈS OU UN DÉMEMBREMENT, OU DES DOMMAGES MATÉRIELS OU ENVIRONNEMENTAUX. IL EST INTERDIT POUR LE CLIENT D'UTILISER LES SERVICES À DE TELS FINS OU ACTIVITÉS OU DANS UN TEL ENVIRONNEMENT.
La liste ci-dessus n'est ni exhaustive ni exclusive. Aux fins de la présente PUA, « Utilisateur final » désigne un utilisateur individuel des Services, et peut être une personne physique, et peut inclure, sans s'y limiter, les employés, consultants, clients, utilisateurs externes, invités, entrepreneurs et agents d'un Client. Sous réserve de la présente, les termes définis dans l'Entente ont la même signification lorsqu'ils sont utilisés dans la présente PUA. Les Services doivent être utilisés exclusivement dans le respect et sous réserve de la Politique des services d'urgence de RingCentral, disponible à https://www.ringcentral.ca/legal/emergency-services.html et de l'Avis de confidentialité de RingCentral, disponible à https://www.ringcentral.ca/legal/privacy-notice.html.
RingCentral se réserve le droit d'agir immédiatement et sans préavis pour suspendre ou résilier les Services si, à sa seule discrétion, l'utilisation des Services par le Client ou ses Utilisateurs finaux enfreint les conditions de la présente Politique d'utilisation acceptable.
Le client peut annuler tout service obtenu en vertu du présent Accord en avisant RingCentral par écrit dans les trente (30) jours suivant la date à laquelle l'achat devient exécutoire. Sous réserve de dispositions contraires dans l'Accord entre les Parties, en cas d'annulation en temps voulu, le Client ne sera redevable d'aucuns frais ou charge pour les services annulés pour toute période postérieure à la date de cette notification par écrit (sauf ceux qui découlent de la continuation de l'Utilisation), et aura droit à un remboursement au prorata des frais prépayés et non utilisés pour les services faisant l'objet de l'annulation. Tous les achats sont considérés comme définitifs après 30 jours.
