Here&#8217;s what healthcare payers should know to prepare before the law goes into effect on January 1, 2022.<\/span><\/p>\n<h2 class=\"heading h2\"><b>What&#8217;s the &#8220;surprise&#8221; in the No Surprises Act?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">\u200bThe No Surprises Act, a $1.4 trillion year-end spending bill centers on so-called \u201csurprise medical billing,\u201d which is actually more commonly known as out-of-network billing. Out-of-network billing happens when a patient receives a bill for the difference between \u200b\u200b\u200b\u200bthe out-of-network provider\u2019s fee and the amount covered by the patient\u2019s health insurance after copays and deductibles.\u200b\u200b\u200b<\/span><\/p>\n<p><span style=\"font-weight: 400;\">How often does that actually happen? According to a<\/span><a href=\"https:\/\/www.kff.org\/health-costs\/poll-finding\/data-note-public-worries-about-and-experience-with-surprise-medical-bills\/\"> <span style=\"font-weight: 400;\">KFF poll<\/span><\/a><span style=\"font-weight: 400;\">, 1 in 3 insured adults between the ages of 18 and 64 received an unexpected medical bill in the last two years. Of those, 16 percent reported they received a \u201csurprise\u201d bill related to care received from an out-of-network provider.<\/span><\/p>\n<p><img decoding=\"async\" class=\"aligncenter size-full wp-image-49912\" src=\"\/us\/en\/blog\/wp-content\/uploads\/2021\/11\/unexpected-medical-bill.png\" alt=\"RingCentral for Healthcare Payers\" width=\"930\" height=\"523\" \/><\/p>\n<p><span style=\"font-weight: 400;\">Further, 65 percent of insured adults between 18 and 64 indicated they are either &#8220;very worried&#8221; (35 percent) or &#8220;somewhat worried&#8221; (30 percent) about being able to afford unexpected medical bills. That concern topped the list of things this age group worries about.<\/span><\/p>\n<p><img decoding=\"async\" class=\"aligncenter size-full wp-image-49913\" src=\"\/us\/en\/blog\/wp-content\/uploads\/2021\/11\/healthcare-worries.png\" alt=\"RingCentral for healthcare payers\" width=\"930\" height=\"523\" \/><\/p>\n<h2 class=\"heading h2\"><b>What the No Surprises Act covers<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The No Surprises Act seeks to lessen this worry for insured Americans by increasing transparency regarding medical billing and patient cost-sharing responsibility. Here are the<\/span><a href=\"https:\/\/www.kff.org\/private-insurance\/fact-sheet\/surprise-medical-bills-new-protections-for-consumers-take-effect-in-2022\/\"> <span style=\"font-weight: 400;\">main requirements<\/span><\/a><span style=\"font-weight: 400;\"> of the law:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Private health plans must cover surprise bills at the in-network rate without prior authorization, and in-network cost sharing must apply.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In-network cost sharing for surprise bills will be based on the &#8220;recognized rate,&#8221; which is usually the median in-network amount for the same or similar services.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If patients feel that their healthcare plan has not correctly handled a surprise bill, the patients have a right to take advantage of federal external appeals to remedy the situation.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Out-of-network providers of emergency or non-emergency services at in-network hospitals are not allowed to balance bill patients beyond the applicable in-network cost sharing amount for surprise bills.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The law specifies that providers \u201cshall not bill, and shall not hold patients liable\u201d for an amount that is more than the in-network cost sharing amount for such services.\u00a0\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">For private health plans regulated at the state level, states may enforce federal requirements. If a patient knowingly and willingly consents to use an out-of-network provider for non-emergency services, the surprise billing protections do not apply.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><a href=\"https:\/\/www.kff.org\/private-insurance\/fact-sheet\/surprise-medical-bills-new-protections-for-consumers-take-effect-in-2022\/\">KFF<\/a> notes regarding this exception: &#8220;An exception applies for certain non-emergency services if providers give prior written notice at least 72 hours in advance and obtain the patient\u2019s written consent. The notice must indicate the provider does not participate in-network, provide a good faith estimate of out-of-network charges, and include a list of other participating providers in the facility whom the patient could select. This exception does not apply for ancillary services (such as anesthesia) or diagnostic services (such as radiology and lab) nor to other services or providers&#8221; specified in the regulation.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><\/p>\n<div class=\"rc-post-content-cta rc-post-content-cta_green\">\n<div class=\"rc-post-content-cta-columns\">\n<div
